Lack of Compassion for Personal Care Employee Allegedly Terminated for Having Cancer

Employee Files Lawsuit Against Rapps Senior Care LLC d/b/a Woodbridge Place for Disability Discrimination and Violation of the Americans With Disabilities Act.
Michelle was hired as a Waitstaff employee around March of 2017. Even though she had both anal and lung cancer, she was still able to perform all the essential duties her job required of her with the assistance of reasonable accommodations – including intermittent time off from work to undergo and recover from medical treatment.
Around May 30th 2018, Michelle knew she would need to be out of work for between four to five days to undergo chemotherapy treatment. She provided a doctor’s note to her Director as she had routinely done before. However, on June 1st, while still recovering from treatment, Michelle received a call from her Supervisor. During the call, the Supervisor allegedly stated that “in the best interest of the company”, Michelle was being terminated.
Due to the timing of the request for time off and the termination, Michelle believes that she was terminated due to her cancer – and as cancer is defined as a disability by the ADA, Michelle believes she was terminated due to her disability.
