Employee Files a Complaint against Mon Yough Community Services for Disability Discrimination and Retaliation

Woman with severe anxiety and depression suffers disability discrimination, retaliation, and job termination.

Pittsburgh, PA, June 9, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for disability discrimination against Mon Yough Community Services, for the Western District of Pennsylvania.

An employee with diagnosed depression and anxiety filed a complaint against Mon Yough Community Services for disability discrimination. Soon after accepting the job, Plaintiff requested accommodation for trainings but heard nothing. Instead, a write up resulted when Plaintiff sought to gain information about an upcoming training. Her supervisor dogged Plaintiff’s every move and issued another write up for Plaintiff’s alleged misbehavior. Finally, halfway through an enforced leave, Plaintiff suffered a false accusation resulting in termination.

Despite discussing how her disabilities affected trainings with her supervisor, Plaintiff’s request for accommodation received no traction. Plaintiff asked about an upcoming training, and her supervisor suggested she contact the training facility. When the training facility complained to the supervisor’s manager, the supervisor, denying she suggested Plaintiff call the facility, wrote Plaintiff up. Harassment from supervisor mounted. While Plaintiff conducted work duties, supervisor excessively “peeked” in on her at the office and during field work. This behavior did not extend to other employees. Then, on a full day of work in the field, Plaintiff received a text from her supervisor followed by a call from the supervisor’s manager demanding an immediate meeting with her. The manager wanted Plaintiff to sign a write up for her misbehavior under the supervisor, but Plaintiff refused. When Plaintiff tried to explain the supervisor’s harassment, the manager shut her down.

Later, when Plaintiff requested two days off, the manager said no to her two days and told her to take 8 weeks off. Halfway through imposed leave, Plaintiff received a letter of termination citing the reason for firing that she falsified agency documents. When Plaintiff was cleared of that accusation, the company did not return her to employment.

Lack of reasonable accommodation and legitimate reason for termination, Mon Yough Community Services shows blatant disrespect for the law on disability discrimination.
