Employee Files a Complaint against Silver Creek Services, Inc. for Retaliation

Manager fired after using approved FMLA leave for back surgery recovery and reporting supervisor’s harassment.

Pittsburgh, PA, June 9, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for retaliation against Silver Creek Services, Inc., for the Western District of Pennsylvania.

Plaintiff filed a retaliation complaint against Silver Creek Services, Inc., because he was fired while on approved FMLA leave to recover from necessary back surgery. The Plaintiff worked for his company for 17 months before taking the FMLA leave. After a successful back surgery and regular recovery, Plaintiff received notice from the doctor that he could return to his work a week early.

When Plaintiff called Human Resources to schedule his return, the Plaintiff learned that his supervisor had fired him. The termination letter, dated a month before the end of Plaintiff’s authorized FMLA leave, cited “job performance issues” for the reason of his termination. These alleged issues occurred more than six months beforehand, and this termination letter was the first disciplinary action taken.

This same supervisor harassed Plaintiff, including excessive screaming in his face and name-calling in front of other employees. When Plaintiff notified Human Resources of the supervisor’s harassment, nothing was done. The harassment continued.

Faulty reasoning for termination coupled with ongoing supervisor harassment reveals the scheme of retaliation in this case of illegal termination.
