Kraemer, Manes & Associates LLC has filed a complaint against Repal Construction Company Inc. and International Fidelity Insurance Company on behalf of NEJ Abatement, Inc. and its president and owner, Kenneth DeHonney in the Court of Common Pleas of Allegheny County.

The complaint alleges that a contract existed between the Plaintiff and Repal for the Plaintiff to selectively demolish, remove asbestos, and remove lead paint at the Cast Iron Building Project for $60,932.00 with additional costs and change orders. The plaintiff began working on October 26, 2012. The complaint further alleges that the Plaintiff followed appropriate procedures for containing the hazardous materials of the building, however, another subcontractor hired by Repal who also was working on lead removal issues. The complaint alleges that Plaintiff witnessed and informed the other subcontractor of their incorrect procedures and subsequent to the work by the other subcontractor, there was possible contamination which required the site to be closed for testing. The complaint further alleges that Defendant has a remaining unpaid balance owed to the plaintiff in the amount of $95,116.78 which has been delinquent since June 30, 2013. The complaint also alleges that International Fidelity Insurance Company, which was Repal’s bonding company, refused the Plaintiff’s claims. The complaint alleges that the Defendant has beached the contractual obligations, has been unjustly enriched, has violated Pennsylvania’s Contractor and Subcontractor Payment Act, and that the International Fidelity Insurance Company owes payment to the Plaintiff in the amount of $95,116.78 if Repal does not make the payment.
