Home Owner Files Lawsuit against Marcus Remodeling for Fraud

John contracted to work with Marcus Remodeling after the company approached him about his home projects. In March 2016, John signed a contract with Marcus Remodeling to have the rear roof pressure washed and general cleaning done. Following the signing, he agreed that more work needed to be done.

In April 2016, he signed a contract to have roofing, trusses, French drain, and a driveway retaining wall installed. John paid the requested $4k promptly. Throughout May and June, Marcus Remodeling continually approached John with new contracts and more payment requests. On ten separate occasions, John was asked for money to finish the work. Each time, he paid with the expectation of good work completion.

A year later, John was still waiting for his French drain to be installed, and the contractors approached him for more payment to do the work as well as to cover labor costs. John paid an additional $13.5k. The French drain was not even started. And then, in November, the roof sheeting blew off. On closer inspection, John discovered that the roof trusses had not been properly installed, and then, the driveway retaining wall failed.

John contacted Marcus Remodeling to request reimbursement for the poor work so that he could get the job done correctly. According to John, the contractors refused to do anything to fix the situation. And as of April 2018, Marcus Remodeling has failed to uphold its end of the contracts.
