Man Files Lawsuit against Officer Culp at Oil City Police Department for Prosecution without Cause.     

Randy became one of the suspects of a criminal investigation led by Officer Culp of the Oil City Police Department. Although Randy had a contentious history with the main suspect of theft, no evidence showed that Randy had participated in the theft. Video footage continued to confirm Randy’s innocence in this crime and to point back to the main suspect.

suited man with arms crossed in front of courthouseOfficer Culp met with the main suspect and listened to his accusations of Randy, including a claim that Randy had followed the main suspect “in public.” Following someone else in public is not an illegal activity. Rather than arrest the main suspect with alleged clear evidence of wrong doing, the officer arrested Randy on the grounds of the main suspect’s accusations. However, no real evidence pointed to Randy, but Officer Culp arrested Randy anyway.

After almost two months of jail time, Randy filed for relief through Habeas Corpus, objecting to his wrongful imprisonment. With no solid evidence against him, Randy asserts that he wasted two months in prison for Officer Culp’s blatant misuse of his authority. The first court’s decision to dismiss 5 of the 7 charges brought against Randy further throws more doubt on Officer Culp. Five months later, the final two charges were dismissed as well. According to Randy, the dismissal of those seven charges reveal how Office Culp fictionalized them.

The law demands that citizens of the United States only be prosecuted with probable cause. Since Officer Culp allegedly arrested Randy without true cause or evidence, he directly contradicted the law. No citizen of the United States should have to deal with such treatment. Naturally, Officer Culp and the Oil City Police Department denies these claims. However, KM&A fights for men like Randy, who have been wronged by individuals trusted to enforce the law.
