Employee Files Lawsuit against PGT Trucking for Disability Discrimination            

Stephen began working for PGT Trucking with a vision for hiring and training racial minorities. His role as director gave him the authority to create the necessary programs. During this time, PGT Trucking transferred Stephen from Ohio to Pennsylvania and housed him in a company condo. Far from luxurious, the condo boasted HVAC issues, bug infestation, and poor water quality. Stephen claims that he requested that these issues be corrected but nothing was done. While in the condo he suffered a spider bite that became abscessed and required special treatment. Once again, he complained about the living conditions but nothing was altered, even though the company recognized the problem.

During his stay at the condo, Stephen became ill multiple times with Acute Bronchitis and Pneumonia. Finally, he contracted Legionella, which is a deadly lung disease. Because Stephen had no previous health problems, he suspected the issues with the HVAC system in the condo had caused his illnesses. When he informed his company of his suspicions, no investigation occurred.

In fact, the CEO of PGT Trucking allegedly blamed Stephen for the ongoing illnesses, saying that it was caused by “fatigue and low resistance.” This is clearly false, as Stephen had no history of health problems prior to living in the condo.

Soon after returning to work full time, Stephen received a notification of Ohio transfer and was required to vacate his condo within 24 hours. Two months later, under the pretense of a meeting, Stephen was terminated.

The chronological events point to the existence of disability discrimination. A previously healthy man, Stephen suffered diseases caused by his employer’s negligence in caring for the company condo, and then Stephen lost his job because of these same diseases contracted while living in the company condo.
