KM&A Files Lawsuit Against Select Medical Corporation

Kraemer, Manes & Associates LLC has filed a complaint against Select Medical Corporation on behalf of Athena Miller in the United States District Court for the Western District of Pennsylvania.

The complaint alleges that Ms. Miller, an individual suffering from one or more disabilities including post-concussive symptoms, requested reasonable accommodations from Select Medical Corporation after being cleared by her physician on March 22, 2013. However, the complaint alleges that Select Medical Corporation refused to discuss any accommodations for Ms. Miller and that Select Medical Corporation informed Ms. Miller that she could only return to work after she was cleared to work full time without restrictions. The complaint further alleges that on May 10, 2013, Ms. Miller was once again cleared by her treating physician to return to work with a recommended reasonable accommodation, but upon notifying Select Medical Corporation, Select Medical Corporation once again informed Ms. Miller that she could only return to work after bring cleared to work full time without restrictions. The complaint alleges that Select Medical Corporation refused to discuss any accommodation and that Ms. Miller was terminated on June 5, 2013, the date her FMLA leave and personal leave was exhausted.

The complaint alleges that the defendant has violated the Americans with Disabilities Act and the Pennsylvania Human Relations Act by discriminating against Plaintiff because of her disabilities and failing to accommodate her disabilities.
