KMA Files Lawsuit Against Vanguard

Kraemer, Manes & Associates, LLC “KM&A” has filed a complaint against The Vanguard Group, Inc. in the United States District Court for the Eastern District of Pennsylvania in Joseph Fee, Et. Al., v. The Vanguard Group, Inc., Case 2:15-cv-06566-LDD.  The complaint alleges that The Vanguard Group, Inc. violated the Fair Labor Standards Act (FLSA), Pennsylvania Minimum Wage Act  (PMWA), and Pennsylvania Wage Payment & Collection Law (PaWP&CL), in mis-classifying and underpaying a class of employees known as Investment Consultants from December 3, 2013 through December 3, 2015.  Investment Consultants for Vanguard were paid a salary, but the Plaintiffs contend that was a mis-classification, and the Investment Consultants should have been paid hourly.  During the foregoing times relevant to the litigation, Investment Consultants worked significant overtime but received no increase in compensation despite the overtime work.  The full text of the complaint, as filed, is available on the United States District Court for the Eastern District of Pennsylvania’s electronic docket accessible at https://ecf.paed.uscourts.gov/cgi-bin/login.pl.
