KM&A Files Lawsuit Against Blair County and Altoona Police Department

Kraemer, Manes & Associates, LLC “KM&A” has filed a complaint against the Altoona Police Department, Blair County, and others for violations of Henry Agnew’s civil and Constitutional Rights.  The lawsuit is currently pending before the United States District Court for the Western District of Pennsylvania, under Case Number 3:15-cv-00252-KRG.

Henry Agnew is an African American male in his mid-thirties who was wrongly accused of rape and other charges and was incarcerated from May 2014 through October 15 2014, when he was acquitted of all charges by a Blair County jury.  Mr. Agnew’s arrest, incarceration, and prosecution stem from incidents which allegedly occurred in the early morning hours of April 19, 2014 when Mr. Agnew and an adult female left an after after hours house party to a park.  At all times Mr. Agnew has maintained the interaction between he and the adult female were consensual, but he was accused of the crimes when the two returned to the house party and happened upon a male adult friend and possible boyfriend of the adult female.  Integral to Mr. Agnew’s claims is a video reviewed by the police and Districat Attorney’s office that shows Mr. Agnew and the adult female at a Sheetz, on their way to the park, where it can be seen that Mr. Agnew is inside the Sheetz and in plain sight purchasing condoms, while the adult female is inside the vehicle on her phone and in no apparent distress.  Mr. Agnew maintains various claims including that the prosecution lacked probable cause and/or would have ceased had he not been African American and/or male.  The best offer made by Defendants pre-trial was five (5) years in prison.  Mr. Agnew is emotionally shaken from the prosecution and his wrongful incarceration.
